Terms of Use
1. INTRODUCTION AND ACCEPTANCE
Welcome to alexsauret.com. This website (“Website” or “Site”) is owned and operated by Alex Sauret (“Alex Sauret,” “we,” “us,” or “our”).
These Terms of Use govern your access to and use of alexsauret.com, including the content, products, artwork, ecommerce features and services made available through the Website.
Please read these Terms of Use carefully before using the Website or purchasing products or services through it. By accessing or using the Website, creating an account, placing an order or otherwise using our products or services, you agree to be bound by these Terms of Use and any policies referenced within them.
If you do not agree with these Terms of Use, please do not use the Website or purchase products or services through it.
Our Privacy Policy, Returns & Refunds Policy, and Delivery & Shipping Policy form part of the terms governing your use of the Website and purchases made through it. Where applicable, additional terms agreed to in writing for commissions, custom artwork or other services will also apply.
Nothing in these Terms of Use is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified under applicable law.
2. CHANGES TO OUR TERMS OF USE AND POLICIES
We may update or modify these Terms of Use and our related policies from time to time to reflect changes to the Website, our products and services, our business practices or applicable legal requirements.
The updated version will be posted on alexsauret.com and will become effective when posted unless otherwise stated or required by applicable law. The “Last Updated” date at the end of these Terms will indicate when the most recent changes were made.
Changes to these Terms will apply prospectively and will not alter the terms applicable to a purchase already completed unless required by law or otherwise agreed with you.
We may also modify, update, suspend or discontinue features, content, products or services offered through the Website. Product availability, pricing and other information may change from time to time as described elsewhere in these Terms.
Your continued use of the Website after updated Terms have become effective constitutes your acceptance of those Terms.
3. INTELLECTUAL PROPERTY
The Website and its content are owned by or licensed to Alex Sauret and are protected by applicable Canadian and international copyright, trademark and other intellectual property laws.
Website content includes, without limitation, original artwork and reproductions of artwork displayed on the Website, photographs and images of artwork, drawings, illustrations, graphics, text, logos, branding, page designs, videos, digital content, product descriptions and other materials made available through alexsauret.com (“Website Content”).
Except for the limited personal-use rights expressly provided in these Terms, no right, title, licence or ownership interest in the Website Content is transferred to you by accessing the Website or purchasing an artwork or other product.
All intellectual property rights not expressly granted under these Terms are reserved by Alex Sauret or the applicable rights holder.
Purchasing an original artwork, print, artist proof or other physical product does not transfer copyright, reproduction rights or other intellectual property rights in the artwork to the purchaser. Ownership of the physical artwork or product is separate from ownership of the copyright in the underlying artwork.
Unless otherwise agreed in writing, Alex Sauret retains all copyright and reproduction rights in artwork sold through or displayed on the Website, including the right to photograph, reproduce, publish, display and use images of the artwork for portfolios, exhibitions, publications, promotional materials, social media, archival purposes and other lawful purposes.
No artwork or image displayed or purchased through the Website may be reproduced, copied, published, commercially exploited, licensed, distributed, minted or used to create derivative products or digital assets without prior written permission from Alex Sauret, except where such use is permitted by applicable law.
4. SCOPE OF USE
Alex Sauret grants you a limited, non-exclusive, non-transferable and revocable right to access and use alexsauret.com and its Website Content for your personal and non-commercial use, subject to these Terms.
You may view the Website and retain reasonable copies of information relating to your own orders or transactions. You may also share links to publicly available pages on alexsauret.com for ordinary personal and non-commercial purposes.
Unless you have received prior written permission from Alex Sauret or the use is otherwise permitted by applicable law, you may not reproduce, modify, republish, distribute, transmit, sell, license, commercially exploit or create derivative works from Website Content.
You may not systematically download, scrape, harvest, extract or compile Website Content or data from alexsauret.com. You may not use automated systems, bots, scripts or similar technologies to access or extract Website Content in a manner that interferes with the Website, circumvents its security measures or exceeds ordinary browsing and legitimate search-engine indexing.
You may not use photographs or reproductions of Alex Sauret’s artwork to manufacture or sell prints, merchandise, digital products or other reproductions without prior written permission.
You may not remove or alter copyright notices, watermarks, attribution, trademarks or other proprietary notices appearing on the Website or its content.
Any commercial use of Website Content requires prior written permission from Alex Sauret.
5. COPYRIGHT AND TRADEMARKS
Artwork, photographs, images, text, graphics, logos, branding and other original content displayed on alexsauret.com are protected by applicable copyright and intellectual property laws.
Alex Sauret retains copyright in his original artwork unless those rights have been expressly transferred through a separate written agreement. The sale or transfer of possession of an original artwork, limited-edition print, artist proof or other physical work does not by itself transfer copyright or reproduction rights in that work.
Purchasers may own, display, gift or, subject to applicable law, resell the physical artwork they purchase. However, ownership of the physical artwork does not give the purchaser the right to reproduce the artwork, create or sell copies, authorize reproductions, use the artwork commercially, create merchandise based on it or otherwise exploit the underlying copyrighted work.
Images of artwork displayed on alexsauret.com may not be copied, downloaded, reproduced, altered, published or used for commercial purposes without prior written permission, except where permitted by applicable law.
The Alex Sauret name, logos and other branding appearing on the Website may be protected by trademark or other applicable laws. Nothing in these Terms grants you permission to use Alex Sauret’s name, branding or marks in a way that suggests sponsorship, endorsement, affiliation or authorization where none exists.
Alex Sauret respects the intellectual property rights of others. If you believe that material appearing on alexsauret.com infringes copyright or another intellectual property right that you own or are authorized to represent, please contact info@alexsauret.com with sufficient information for us to identify and review the material in question.
6. USER REPRESENTATIONS
By accessing or using alexsauret.com, creating an account, submitting information, placing an order or otherwise interacting with the Website, you represent that the information you provide is accurate, current and complete to the best of your knowledge.
You agree to use the Website only for lawful purposes and in accordance with these Terms of Use and applicable laws and regulations.
You must have the legal capacity to enter into a binding agreement in your jurisdiction or, where permitted, use the Website and make purchases with the involvement and authorization of a parent or legal guardian.
You agree not to use the Website through unauthorized automated or non-human means, interfere with the operation or security of the Website, impersonate another person, provide false or misleading information, attempt to gain unauthorized access to another user’s account, or use the Website for fraudulent, illegal or unauthorized purposes.
If you provide information that is materially false, inaccurate or misleading, misuse the Website, engage in suspected fraudulent activity or otherwise violate these Terms, we may take reasonable action including refusing or cancelling an order, restricting access to the Website, or suspending or terminating an account where appropriate.
Nothing in this section limits any rights or remedies available to either you or Alex Sauret under applicable law.
7. USER REGISTRATION
Certain features of alexsauret.com may allow you to create a customer account. Registration is not necessarily required to browse the Website, and where guest checkout is available, you may be able to make a purchase without creating an account.
When creating an account, you agree to provide accurate and current information and to update that information when reasonably necessary, particularly where changes may affect an order, payment, shipping or communication with you.
You are responsible for maintaining the confidentiality of your account credentials and for taking reasonable precautions to prevent unauthorized access to your account. You should not share your password with another person.
If you believe that your account or password has been compromised or used without your authorization, please contact info@alexsauret.com promptly.
We may suspend or restrict access to an account where we reasonably believe it has been compromised, is being used fraudulently, violates these Terms, or presents a security risk to the Website or other users.
Personal information associated with customer accounts is handled in accordance with our Privacy Policy.
8. PRODUCTS
Alex Sauret offers original artwork, limited-edition prints, artist proofs and other art products through alexsauret.com. Commissioned or custom artwork and other creative services may also be offered or arranged separately.
We make reasonable efforts to describe and display each artwork and product accurately, including its title, medium, dimensions, edition information, framing where applicable, and other relevant characteristics.
However, colours and visual details may appear differently depending on your screen, device, browser, lighting and display settings. Photographs and digital images are provided to represent the artwork as accurately as reasonably possible but cannot guarantee an exact representation of colour, texture, scale or other physical characteristics.
Original artworks are one-of-one pieces unless expressly stated otherwise. Once an original artwork has been sold, it may no longer be available for purchase.
Limited-edition prints and artist proofs may be available only in the quantities or editions identified on the applicable product page. Edition numbers, artist-proof designations, dimensions, materials, printing methods and other product-specific details will be described on the product page where applicable.
Some prints or other products may be produced or prepared after an order is placed. Production and processing times are estimates and may vary. Please refer to our Delivery & Shipping Policy for additional information regarding processing and delivery.
Framing is included only where expressly stated in the product description. Any frame, display setting, room image, mockup or other presentation shown in product photography should not be assumed to be included unless the product page specifically says so.
We reserve the right to correct errors or inaccuracies in product descriptions, pricing, availability or other information. If a material error affects an order you have already placed, we will contact you and, where appropriate, provide the option to proceed with the corrected information or cancel the affected order for a refund.
We may limit the quantity of a product available for purchase where reasonably necessary, including to preserve stated edition limits, prevent fraud or unauthorized commercial resale, or correct an inventory error.
Product availability and pricing may change without notice before an order is placed. A change in price after a completed purchase will not affect the price already agreed for that purchase, except where an obvious pricing error has occurred and applicable law permits correction.
The purchase of an artwork or other physical product transfers ownership of that physical item only. Copyright, reproduction and other intellectual property rights remain subject to Sections 3 and 5 of these Terms.
9. PURCHASES AND PAYMENT
Unless otherwise stated, prices displayed on alexsauret.com are in Canadian dollars (CAD).
Applicable taxes, shipping charges and other charges will be calculated or disclosed during checkout where possible, or otherwise communicated before the purchase is completed. International customers may also be responsible for customs duties, import taxes, brokerage fees or other charges imposed by the destination country, as described in our Delivery & Shipping Policy.
We currently accept payments through PayPal. Additional payment methods, including Apple Pay where available, may also be offered through our payment provider. The payment methods available to you may depend on your device, location, browser or other requirements of the applicable payment provider.
Payments are processed by third-party payment providers and are subject to their applicable terms, conditions and privacy practices. Alex Sauret does not directly store complete credit or debit card information.
You agree to provide accurate, current and complete billing, shipping and purchase information. You are responsible for reviewing your order, product selection, billing information and delivery address before completing your purchase.
If you pay using a currency other than Canadian dollars, your payment provider or financial institution may convert the transaction into your local currency. Exchange rates and foreign transaction, conversion or other financial-institution fees are determined by the applicable provider and are outside Alex Sauret’s control.
An order is subject to acceptance and product availability. We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, payment failure, incorrect pricing, inventory errors, duplicate orders, technical errors, shipping restrictions or other circumstances that prevent us from reasonably fulfilling the order.
If we cancel an order after payment has been successfully collected, we will refund the applicable amount to the original payment method unless another method is agreed or required.
For original artwork, commissioned artwork, oversized pieces or other purchases requiring special delivery arrangements, additional payment, shipping or delivery terms may be agreed with you before the transaction is completed.
Cancellations, refunds, damaged shipments and related matters are governed by our Returns & Refunds Policy and Delivery & Shipping Policy, together with any rights available under applicable law.
10. GUIDELINES FOR REVIEWS
Where alexsauret.com allows customers or visitors to submit product reviews, ratings or other public feedback, you agree that your submission will reflect your genuine experience and will not contain information that you know to be false or misleading.
Reviews and ratings must not contain unlawful, threatening, defamatory, harassing, discriminatory, hateful, obscene or otherwise abusive content. They must not infringe another person’s copyright, trademark, privacy or other legal rights, disclose another person’s personal information without authorization, contain malicious code or spam, or promote illegal activity.
You may not impersonate another person, submit a review using materially false information, manipulate ratings or reviews, or organize or participate in deceptive campaigns intended to artificially increase or decrease the reputation of a product, person or business.
We reserve the right, but are not obligated, to moderate, refuse or remove reviews that violate these Terms, applicable law, or the reasonable operation and integrity of the Website.
Reviews represent the opinions of the individuals who submit them and do not necessarily represent the views of Alex Sauret.
By voluntarily submitting a review or other content for public display on the Website, you grant Alex Sauret a non-exclusive, worldwide, royalty-free licence to display, reproduce and format that content as reasonably necessary to operate, promote and display the Website and its products. You retain ownership of your original content.
If a review includes a photograph or other content that you did not create, you must have the necessary permission to submit it and grant the rights described above.
11. USER COMMENTS AND SUBMISSIONS
You may choose to send us questions, comments, feedback, suggestions, reviews, inquiries or other communications through alexsauret.com, by email or through other methods we make available.
You are responsible for the content you submit and represent that you have the right to provide it. Your submissions must not violate applicable law or infringe the copyright, trademark, privacy, publicity or other rights of another person. You may not knowingly submit false, misleading, defamatory, abusive, obscene, fraudulent or unlawful material, malicious code, spam or other content intended to interfere with the operation or security of the Website.
Unless otherwise agreed, general comments, suggestions and feedback about alexsauret.com or our products and services are not considered confidential. By submitting such feedback, you permit us to use it for reasonable business purposes, including improving the Website, products and services, without an obligation to compensate you.
This does not mean that artwork, photographs, designs, reference materials or other original creative material you provide in connection with a commission or project automatically becomes the property of Alex Sauret. Ownership and permitted use of such materials remain subject to applicable intellectual property law and any separate agreement between you and Alex Sauret.
If you provide photographs, images, designs or other materials for use as references in a commission or custom project, you represent that you own those materials or otherwise have sufficient permission to provide and authorize their use for the agreed project.
We reserve the right, but are not obligated, to remove or restrict content submitted to the Website where we reasonably believe it violates these Terms, applicable law, the rights of another person or the proper operation of the Website.
12. SITE MANAGEMENT
We reserve the right to manage alexsauret.com in a manner reasonably necessary to protect the Website, our customers, our intellectual property, our business and the rights of others.
We may monitor the Website for misuse or violations of these Terms, investigate suspected fraudulent, unlawful or unauthorized activity, restrict or disable access where reasonably necessary, remove content that violates these Terms, and take appropriate action to protect the security and proper operation of the Website.
We may suspend or terminate accounts, restrict transactions or refuse access to portions of the Website where we reasonably believe an account or user is involved in fraud, unauthorized activity, security threats, abuse or material violations of these Terms.
Where appropriate, we may cooperate with law enforcement, regulatory authorities, payment providers, financial institutions, shipping providers or other relevant parties in connection with suspected fraud, unlawful activity, security incidents or legal obligations.
Nothing in this section requires us to continuously monitor the Website or user activity.
13. MODIFICATIONS AND INTERRUPTIONS
We may modify, update, suspend or discontinue all or part of alexsauret.com, its features or its ecommerce functionality from time to time.
We make reasonable efforts to keep the Website available and functioning properly, but we cannot guarantee uninterrupted or error-free access. The Website may occasionally be unavailable because of maintenance, software or hardware issues, security updates, hosting interruptions, technical problems or circumstances outside our reasonable control.
We may correct, update or remove Website Content where necessary, including product information, availability, pricing or other information. Material errors affecting an existing order will be handled in accordance with the Products and Purchases & Payment sections of these Terms.
Alex Sauret will not be responsible for temporary Website interruptions or technical problems outside our reasonable control, except to the extent responsibility cannot lawfully be excluded or limited.
Website downtime does not affect rights or obligations arising from an order already accepted, except where the interruption prevents us from performing an obligation and another resolution is required under these Terms or applicable law.
14. CONDITIONS FOR LINKING TO WEBSITE
You may link to publicly available pages on alexsauret.com for lawful purposes without requesting prior permission, provided that the link is used in a fair and accurate manner.
A link to alexsauret.com must not falsely suggest that Alex Sauret sponsors, endorses, is affiliated with or has approved you, your website, your organization, your products or your services where no such relationship exists.
You may not use Alex Sauret’s name, artwork, images, logos or other intellectual property in connection with a link in a manner that infringes our intellectual property rights, misrepresents the source of the content or creates a false impression of endorsement or affiliation.
You may not frame alexsauret.com within another website or reproduce substantial Website Content as a substitute for linking to the original page without prior written permission.
We reserve the right to request removal of a link that infringes our rights, misrepresents its relationship with Alex Sauret or is otherwise unlawful.
15. EXTERNAL LINKS
For your convenience, alexsauret.com may contain links to third-party websites, social media platforms, payment providers or other external services that are not owned or controlled by Alex Sauret.
The inclusion of a link does not necessarily constitute an endorsement, sponsorship or recommendation of the third-party website, its operator, content, products or services.
Alex Sauret does not control and is not responsible for the availability, content, accuracy, privacy practices, security or operation of third-party websites or services.
If you choose to visit an external website or use a third-party service, you do so subject to that third party’s applicable terms, policies and practices. We encourage you to review those terms and privacy policies where appropriate.
Nothing in this section limits any responsibility that Alex Sauret may have for a third-party service where such responsibility cannot lawfully be excluded.
16. NO UNLAWFUL OR PROHIBITED USE
You may use alexsauret.com only for lawful purposes and in accordance with these Terms of Use.
You may not use the Website in any manner that could damage, disable, overburden, disrupt or impair the Website, its servers, networks, ecommerce functionality or security, or interfere with another person’s use of the Website.
You may not attempt to gain unauthorized access to the Website, customer accounts, administrative areas, servers, systems, networks or information through hacking, password mining, credential theft, circumvention of security measures or any other unauthorized means.
You may not use automated systems, bots, scripts, scrapers, data-mining tools or similar technologies to systematically access, collect, reproduce or extract Website Content or data without prior written permission, except for ordinary search-engine indexing and other uses expressly permitted by us or applicable law.
You may not use the Website to impersonate another person, submit fraudulent information, make unauthorized purchases, interfere with transactions, distribute spam or malicious software, collect personal information about other users without authorization, or engage in conduct that violates applicable law or the rights of another person.
You may not circumvent features intended to protect Website Content or restrict access to certain portions of the Website, remove copyright or proprietary notices, reverse engineer Website software except where such restriction is prohibited by law, or use the Website or its content for unauthorized commercial purposes.
You may not use Alex Sauret’s artwork, images, Website Content or other intellectual property to train, develop, provide input to, or create datasets for artificial intelligence or machine-learning systems without prior written permission from Alex Sauret, except where such restriction is prohibited by applicable law.
We reserve the right to restrict access, suspend accounts, refuse transactions or take other reasonable action where we believe the Website is being used unlawfully, fraudulently or in material violation of these Terms.
17. SPAMMING AND UNAUTHORIZED COMMUNICATIONS
You may not use alexsauret.com, its contact forms, customer accounts or information obtained through the Website to send spam, unsolicited commercial messages, fraudulent communications or other unauthorized solicitations.
The harvesting, scraping or automated collection of email addresses, contact information or other personal information from alexsauret.com for marketing, solicitation, data aggregation or other unauthorized purposes is prohibited.
You may not use Website forms or communication features to transmit malicious code, repetitive messages, deceptive inquiries or content intended to interfere with the Website or our ability to respond to legitimate customers.
Legitimate business, media, gallery, collaboration, commission or other professional inquiries are welcome and may be directed to info@alexsauret.com.
18. DISCLAIMER OF WARRANTIES
We make reasonable efforts to maintain alexsauret.com and to provide accurate and current information about our artwork, products and services. However, except as expressly stated in these Terms or required by applicable law, the Website and its general informational content are provided on an “as is” and “as available” basis.
We do not guarantee that the Website will always be available, uninterrupted, secure or free from technical errors, viruses or other harmful components. Website functionality may occasionally be affected by maintenance, hosting services, software, networks or circumstances outside our reasonable control.
We make reasonable efforts to ensure that product descriptions, dimensions, edition information, photographs, pricing and availability are accurate. However, errors may occasionally occur and will be handled in accordance with the Products and Purchases & Payment sections of these Terms.
Images displayed on the Website are intended to represent the artwork as accurately as reasonably possible. Actual colours, textures, scale and other visual characteristics may differ from their appearance on a screen because of photography, lighting, browser settings, device displays and other factors.
To the fullest extent permitted by applicable law, we disclaim warranties relating solely to the operation and general informational content of the Website that are not expressly provided in these Terms.
Nothing in this section excludes, restricts or modifies any warranty, condition, consumer right or other protection that cannot lawfully be excluded or limited.
19. GOVERNING LAW, LOCATION AND MISCELLANEOUS
These Terms of Use and your use of alexsauret.com are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles, except where the mandatory laws of another jurisdiction apply and cannot lawfully be excluded.
Subject to any mandatory consumer rights, dispute-resolution rights or jurisdictional protections available under applicable law, disputes arising from these Terms, the Website or products and services provided through the Website will be subject to the jurisdiction of the courts of Ontario, Canada.
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where possible. If it cannot be made enforceable, it will be severed from these Terms without affecting the validity or enforceability of the remaining provisions.
Failure by Alex Sauret to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or our right to enforce it in the future.
20. SEPARATE AGREEMENTS, COMMISSIONS AND CUSTOM WORK
Certain products or services offered by Alex Sauret may be subject to additional or separate written terms. This may include commissioned artwork, custom artwork, installations, creative services, special orders, licensing arrangements, collaborations or other projects that require terms specific to the work being provided.
Separate terms may address matters such as the scope and specifications of the work, dimensions, materials, reference images, pricing, deposits, payment schedules, revisions, approvals, production timelines, delivery or installation, cancellation, intellectual property rights and other project-specific requirements.
Where a separate written agreement, proposal, invoice or other agreed project terms apply, those terms are in addition to these Terms of Use.
If a specific provision of a separate written agreement directly conflicts with these Terms of Use, the provision specifically agreed for that project will govern that matter to the extent of the conflict.
Unless expressly agreed otherwise in writing, commissioning or purchasing an original artwork does not transfer copyright or reproduction rights in the artwork. Copyright and other intellectual property rights remain subject to Sections 3 and 5 of these Terms.
If a client provides photographs, designs, logos, text, reference materials or other content for use in a commissioned or custom project, the client represents that they own the material or have the rights and permissions necessary for Alex Sauret to use it for the agreed project.
Nothing in this section creates an obligation for Alex Sauret to accept a commission, custom project or other requested work. The scope, availability and acceptance of such projects will be determined individually.
21. DISPUTE RESOLUTION
If a dispute or concern arises relating to alexsauret.com, an order, artwork, product, service or these Terms of Use, we encourage you to contact us first at info@alexsauret.com so that we have an opportunity to understand the issue and work toward a reasonable resolution.
Both parties agree to make reasonable efforts to resolve a dispute through good-faith communication before commencing formal legal proceedings, where appropriate and where doing so does not prejudice any legal right or applicable limitation period.
If a dispute cannot be resolved informally, it may be brought before a court or other dispute-resolution body having jurisdiction in accordance with Section 19, Governing Law and Jurisdiction.
Alex Sauret and a customer may mutually agree to mediation, arbitration or another form of alternative dispute resolution after a dispute arises. Unless separately agreed in writing, however, these Terms do not require either party to submit a dispute to mandatory arbitration.
Nothing in this section limits any right to seek urgent or appropriate legal relief where necessary to protect intellectual property, prevent fraud, address unauthorized use of the Website or artwork, or protect another legal right.
Nothing in these Terms limits any consumer protection, dispute-resolution or other right that cannot lawfully be waived or restricted.
22. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Alex Sauret will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising solely from your use of, or inability to use, alexsauret.com, including losses resulting from temporary Website interruptions, technical errors or third-party services outside our reasonable control.
We are not responsible for losses caused by inaccurate information supplied by a customer, unauthorized use of a customer’s account resulting from the customer’s failure to take reasonable security precautions, or circumstances outside our reasonable control, except where responsibility cannot lawfully be excluded or limited.
Third-party services, including payment providers, shipping carriers, social media platforms and external websites, may be subject to their own terms and limitations. Nothing in this section excludes any responsibility Alex Sauret may have for our own obligations in connection with those services where such responsibility cannot lawfully be excluded.
To the fullest extent permitted by applicable law, where Alex Sauret is found liable for a claim arising from a particular product, order or paid service, our aggregate monetary liability relating to that claim will not exceed the amount paid to Alex Sauret for the product, order or service giving rise to the claim.
The limitation above does not apply where liability cannot lawfully be limited or excluded, including any rights or remedies available to you under applicable consumer protection or other mandatory laws.
Nothing in these Terms is intended to exclude or limit liability for fraud, fraudulent misrepresentation, wilful misconduct, or any other liability that cannot lawfully be excluded or limited.
23. INDEMNITY
To the extent permitted by applicable law, you agree to indemnify and hold Alex Sauret harmless from reasonable claims, losses, liabilities, damages and expenses, including reasonable legal costs, arising directly from your unlawful use of alexsauret.com, your material violation of these Terms, your infringement of another person’s intellectual property or other legal rights, or content or materials you provide where you did not have the necessary rights or permission to provide or authorize their use.
This includes, where applicable, claims arising from photographs, designs, logos, text, images, reference materials or other content you provide for use in a commission, custom artwork or creative project where your use or provision of that material infringes the rights of a third party.
Your indemnification obligation does not apply to the extent that a claim, loss or damage was caused by Alex Sauret’s own unlawful conduct, negligence or breach of these Terms.
We reserve the right to participate in the defence or settlement of a claim involving our rights or interests. You may not agree to a settlement that admits wrongdoing by Alex Sauret, imposes an obligation on Alex Sauret or materially affects our rights without our prior written consent.
Nothing in this section requires you to indemnify Alex Sauret to an extent prohibited by applicable law.
24. TERMS AND TERMINATION
These Terms of Use remain in effect while you access or use alexsauret.com or maintain a customer account, and continue to apply to transactions, obligations and rights arising while the Terms were in effect where their nature requires them to continue.
You may stop using the Website at any time. If you have a customer account and would like it closed, you may contact info@alexsauret.com, subject to our need to retain certain transaction or other information as described in our Privacy Policy and as required or permitted by law.
We may suspend, restrict or terminate access to an account or to portions of the Website where we reasonably believe that a user has materially violated these Terms, engaged in fraud or unlawful activity, compromised Website security, infringed intellectual property rights or otherwise used the Website in a manner that creates a material risk to Alex Sauret, our customers or others.
Where reasonably possible and appropriate, we may provide notice or an opportunity to correct the issue before terminating an account. Immediate action may be taken where necessary to address fraud, security threats, unlawful conduct or serious violations of these Terms.
Termination or suspension of access does not automatically cancel or eliminate rights or obligations arising from an existing order or transaction. Any outstanding purchase, refund, payment, delivery or other obligation will continue to be handled according to the applicable terms and policies unless the order is separately cancelled or refunded.
Provisions that by their nature should continue after termination will survive, including provisions relating to intellectual property, copyright, payments and outstanding transactions, separate agreements, limitation of liability, indemnity, governing law and dispute resolution.

We will not use your personal information for purposes that are materially different from those described in this Privacy Policy without providing appropriate notice or obtaining consent where required by law.
We do not sell or rent your personal information.
4. HOW WE PROTECT YOUR INFORMATION
We take reasonable administrative, technical and organizational measures to protect the personal information under our control against unauthorized access, disclosure, loss, misuse, alteration or destruction.

While we take reasonable precautions to protect personal information, no website, electronic transmission or method of electronic storage can be guaranteed to be completely secure. We therefore cannot guarantee absolute security of information transmitted through or stored in connection with the website.
If we become aware of a privacy or security breach involving personal information under our control, we will take reasonable steps to investigate and address the incident and will provide notification where required by applicable law.
5. WHO WE SHARE YOUR DATA WITH
We do not sell, rent or trade your personal information to third parties.
We may share personal information with trusted third-party service providers where necessary to operate our website, process transactions, fulfil orders, deliver artwork, provide customer service, maintain website security or perform other services on our behalf.

These service providers may access personal information only to the extent reasonably necessary to perform their services.
Some of our service providers may process or store information outside Canada. As a result, personal information may be subject to the laws of the jurisdiction in which it is processed or stored and may be accessible to courts, law enforcement or governmental authorities in accordance with those laws.
We may also disclose personal information where required by law, regulation, court order or other lawful process, or where we reasonably believe disclosure is necessary to protect our rights, property, website, customers or others.
If the ownership or operation of the website or business changes in the future, information associated with the business may be transferred as part of that transaction, subject to applicable privacy laws.

Returns & Refunds Policy
Returns
All artwork and prints are sold as final sale. Because many pieces are original artworks, limited editions, artist proofs, or produced specifically for the order, we do not accept returns or exchanges for change of mind.
If your artwork arrives damaged during shipping, please contact info@alexsauret.com within 7 days of delivery and include your order number along with clear photographs of the artwork and its packaging.
Please keep the original packaging while we review the issue, as it may be required for a shipping claim.
If the damage occurred during shipping, we will work with you to determine the appropriate solution. Depending on the artwork and its availability, this may include a replacement, repair, or refund.
Damage that occurs after delivery as a result of handling, installation, storage, or other actions by the recipient is not eligible for replacement or refund.
Refunds
Because our artwork and prints are final-sale items, refunds are not normally offered for change of mind.
If your order arrives damaged, is incorrect, or there is another problem with your purchase, please contact info@alexsauret.com as soon as possible. We want the opportunity to review what happened and work with you toward an appropriate solution.
Where a replacement is not possible, for example, with a one-of-one original artwork or artist proof, another resolution may be offered depending on the circumstances.
Any refund or other resolution will be determined based on the individual circumstances of the order and in accordance with applicable consumer protection laws.
Delivery & Shipping Policy
Payment & Order Processing
Payment for products purchased through the website is due in full when the order is placed, unless otherwise agreed in writing.
For original artwork purchased by contacting Alex directly, payment and delivery arrangements will be confirmed before the artwork is released or shipped.
Order Cancellations
If you need to cancel an order, please contact info@alexsauret.com as soon as possible.
An order may be cancelled for a full refund if it has not yet been shipped or entered production as a made-to-order item. Once an order has been shipped, or production of a made-to-order item has begun, it can no longer be cancelled.
Approved cancellations will be refunded to the original method of payment. Please allow your payment provider’s normal processing time for the refund to appear.
Shipping
Shipping costs are calculated based on the artwork, package size and weight, and delivery destination. Applicable shipping charges will be shown during checkout or provided when arranging the purchase of an original artwork.
Orders are carefully packaged according to the type and size of the artwork to help protect them during transit.
Once your order has shipped, tracking information will be provided when available.
Processing Times
Processing times vary depending on the product.
Original artworks that are ready for shipment will generally be prepared and dispatched once payment and delivery arrangements have been confirmed.
Prints and other made-to-order products require additional production time before shipping. Estimated production or processing times provided on the product page are estimates and may vary.
If an unexpected delay significantly affects your order, we will contact you using the email address provided with your purchase.
Shipping Destinations
We ship within Canada and to many international destinations. Shipping availability and cost depend on the destination and the size and type of artwork.
Some oversized or original artworks may require special shipping arrangements. If necessary, we will contact you after your purchase or inquiry to confirm the available delivery options.
We do not ship to P.O. boxes where the selected carrier or shipment type requires a physical delivery address.
Shipping to a Different Address
You may enter a shipping address that is different from your billing address during checkout.
Please review both addresses carefully before submitting your order.
Incorrect Shipping Information
Shipping labels are created using the information provided with your order.
If you notice an incorrect or incomplete shipping address, contact info@alexsauret.com immediately with your order number and the correct information.
We will make every reasonable effort to update the address before shipment. Once an order has been transferred to the carrier, however, we may not be able to change its destination.
Additional shipping or redelivery charges resulting from incorrect information supplied with the order may be the responsibility of the purchaser.
Lost or Damaged Shipments
If your order is lost in transit or arrives damaged, contact info@alexsauret.com as soon as possible and include your order number and tracking information.
For damaged shipments, please also provide clear photographs of the artwork and its packaging and retain all original packaging while the issue is being reviewed.
We will work with the carrier and with you to determine an appropriate resolution. Please refer to our Returns & Refunds Policy for additional information regarding damaged artwork, replacements and refunds.
Shipping Charges & Refunds
Original shipping charges are generally non-refundable once an order has shipped.
If an order is returned or requires redelivery because an incorrect or incomplete shipping address was provided, any additional shipping costs may be charged to the purchaser.
If an error on our part results in the wrong product being shipped, we will work with you to correct the order at no additional shipping cost.
Customs, Duties & Import Fees
International orders may be subject to customs duties, import taxes, brokerage fees or other charges imposed by the destination country.
These charges are not included in the product price or shipping cost unless specifically stated otherwise and are the responsibility of the purchaser.
Customs requirements and fees vary by country. Please contact your local customs authority if you need information about charges that may apply to your order.
Delays Outside Our Control
Occasionally, shipping or production may be delayed by circumstances outside our reasonable control.
If we become aware of a significant delay affecting your order, we will contact you as soon as reasonably possible and work with you to determine the appropriate next step.
